Monthly Meeting Minutes
January 28, 2009
Meeting called to order: 6:10 P.M.

Residents in attendance: None
Read & Approved Minutes of Prior Meeting – Elaine moved to dispense with reading, and the motion was seconded and passed As no addition or corrections were needed, the minutes will be filed.
Review & Submit Monthly Financial Statements
a. Cathy reports that the water bill is down because the water has been turned off by the landscaper. Some trees have been trimmed and paid for. Financial report will be filed for audit.
b. Brent has submitted an estimate to tend 3 trees on 99th that are dangerous, and to trim 60 trees. Eldora states that Shawn was supposed to maintain trees. M’Kendra moves that the bid for $100 per tree be approved to remove the 3 trees on 99th that are dangerously leaning. The motion was seconded and passed.
Landscape Committee:
Shawn is still working on a maintenance schedule for all landscaping.
Newsletter: The newsletter will be completed in February for the March billing. Eldora requests articles.
Management report:
- There will be a library fee at the new library for meeting rooms. There will be some exceptions. We will be looking for a meeting space for February and March. Eldora will offer her home for February and March if necessary.
Cathy attended the Ekmart meeting regarding bankruptcy and HOAs.
Welcome letter:
Lot 179 Mark and Kathleen ForesterWritten Appeals:
a. Lot 65. Homeowner requests waiver of late fees for the reason that he wants to start the new year without owing the HOA. Elaine moved to waive the late fees and to send a letter that if dues are late again, the waived late fees will be re-instated. The motion was seconded and approved.
b. Lot 111. Homeowner requests not to be found in violation of painting maintenance requirements because he’s painted his house; however, the violation is specific to the exterior fence wall which was not painted. M’Kendra moved to send a letter to homeowner with pictures that specifically show the damage on exterior fence wall, and to advise the homeowner that he needs to come into compliance by March 1. The motion was seconded and approved.
c. Lot 320 – Homeowner requests waiver of fines and late fees. In light of homeowner’s current compliance and other mitigating factors, M’Kendra moved to waive the $1, 850.00 in fines; however, the homeowner will be expected to pay NSF charges of $150.00 and $320.00 for finance charges incurred for late dues. The motion was seconded and approved.
Architectural Requests
a. Lot 245. Elaine moved to approve the homeowner’s new front door. The motion was seconded and passed and the request was approved.
b. Lot 561. Elaine moved to approve the homeowner request for a variance for a front door that has already been painted with a color not on the current color palette. In discussion, Eldora advised that she had seen the door and could support the variance under the circumstances. The motion was seconded and approved.
Board Concerns
: Many in the neighborhood received a flyer from Direct TV that appeared to come from the HOA, much to the frustration of some board members who received it. Per Cathy, we can’t prevent solicitors in the neighborhood, even those who appear to misrepresent themselves in flyers.Meeting adjourned at 7:00 P.M.
